Summary: These terms govern your use of My 11+ Tutor and My 11+ Tutor - Progress Monitor apps. By using our apps, you agree to these terms.
1. Acceptance of Terms
By downloading, installing, or using "My 11+ Tutor" or "My 11+ Tutor - Progress Monitor" (collectively, "the Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Apps.
2. Description of Services
2.1 My 11+ Tutor (Child App)
A free educational app providing practice questions for UK 11+ entrance examinations. Features include:
- Over 17,000 practice questions across all 11+ subjects
- Progress tracking and achievements
- Timed mock examinations
- School database and information
2.2 My 11+ Tutor - Progress Monitor (Parent/Tutor App)
A companion app for parents and tutors to monitor children's learning progress. Features include:
- Real-time progress dashboard
- Performance analytics and spider diagrams
- PDF report generation
- Multi-child/student monitoring
3. User Accounts and Eligibility
The Apps do not require user accounts. Data synchronisation between apps uses Apple's CloudKit service with your Apple ID.
The child app is designed for children aged 9-11 preparing for 11+ examinations. Children should use the app with parental awareness.
4. Subscriptions and Payments
4.1 Free Features
My 11+ Tutor (child app) is completely free with no in-app purchases. Progress Monitor offers a free tier with basic monitoring features.
4.2 Premium Subscriptions
Progress Monitor offers the following subscription tiers:
- Family: Up to 3 children, full analytics and reports
- Tutor: Up to 10 students, comparison tools
- Centre: Up to 30 students, administrative features
4.3 Billing
- Subscriptions are billed monthly or annually through your Apple ID
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
Auto-Renewal: Subscriptions automatically renew unless you cancel. To cancel, go to Settings > [Your Name] > Subscriptions on your iPhone or iPad at least 24 hours before your renewal date.
4.4 Cancellation
- You may cancel your subscription at any time through your Apple ID account settings
- Cancellation takes effect at the end of the current billing period
- You will retain access to premium features until the end of your paid period
- No partial refunds are provided for unused portions of a subscription period
4.5 Refunds
Refund requests are handled by Apple according to their refund policy. To request a refund:
- Visit reportaproblem.apple.com
- Sign in with your Apple ID
- Select the subscription purchase
- Follow the prompts to request a refund
5. Intellectual Property
All content in the Apps, including questions, explanations, graphics, and software, is owned by My 11+ Tutor or its licensors and is protected by copyright and other intellectual property laws.
You may not:
- Copy, reproduce, or distribute the content
- Reverse engineer the Apps
- Use the content for commercial purposes
- Create derivative works based on the content
6. Privacy and Data
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data.
6.1 Data Sharing Between Apps
When you pair the child app with Progress Monitor:
- Practice session data (questions answered, scores, time) is shared via CloudKit
- Data is stored in Apple's iCloud infrastructure
- Only paired parent/tutor accounts can access the child's data
- You can disconnect pairing at any time to stop data sharing
6.2 Data Retention
- Local data is stored on your device until you delete the app or reset progress
- CloudKit data is retained while your subscription is active
- After subscription cancellation, shared data may be deleted after 90 days
7. Acceptable Use
You agree not to:
- Use the Apps for any unlawful purpose
- Attempt to gain unauthorised access to the Apps or related systems
- Interfere with or disrupt the Apps' functionality
- Share your subscription with others outside your household (Family tier) or organisation (Tutor/Centre tiers)
8. Disclaimers
The Apps are provided "as is" without warranties of any kind. We do not guarantee:
- That the Apps will be error-free or uninterrupted
- That using the Apps will result in passing any examination
- The accuracy of school information or examination requirements
Educational content is for practice purposes and may not reflect actual examination content.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Apps.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the Apps or by email if you have provided one. Continued use of the Apps after changes constitutes acceptance of the new Terms.
11. Termination
We may terminate or suspend your access to the Apps at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
